These Terms and Conditions ("Terms") govern your use of the arkasoai.com website and any services provided by Arkaso AI ("Arkaso AI," "we," "us," or "our"). By using our website or purchasing our services, you agree to these Terms.

Services

Arkaso AI builds, configures, and deploys AI voice receptionist and lead automation systems for HVAC contractors and other service businesses. Services are provided on a monthly subscription basis, as described in your service agreement. There is no setup fee.

The specific scope, tier, and pricing for your engagement are set out in the agreement you sign. These Terms govern the general relationship; your service agreement governs the specifics. Where they conflict, the service agreement controls.

What Our Systems Do and Do Not Do

Our voice systems answer inbound calls, collect caller information, answer questions based on the information you provide, and schedule appointments.

Our systems do not:

Diagnose technical problems or provide professional advice

Quote pricing on work requiring professional assessment

Guarantee that every call will be handled without human involvement

Replace licensed professional judgment in your trade

You remain responsible for the work your business performs and for the accuracy of the information you provide us to configure your system.

Setup and Deployment

We aim to have your system live within seven days of receiving the information needed to configure it. If it is not live within seven days, your first three months do not start until it is. Timelines depend on your responsiveness during onboarding and on third-party approvals outside our control, including carrier registration for text messaging.

Payment

The first three months ($1,491) are paid upfront before deployment begins. There is no setup fee

After the first three months, service is $497 per month, billed in advance on the same day each month

Payment is by the method authorized in your service agreement

Fees are non-refundable except as stated in your service agreement

Service includes 1,000 minutes of calls per month. Additional minutes are billed at $0.35 per minute, and you will receive a text alert at 80% of your included minutes

Failure to pay may result in suspension of services after reasonable notice.

Cancellation

The first three months are prepaid and non-refundable. After that, service is month to month, and either party may cancel at any time with written notice. Prepaid monthly fees are not refunded for partial months unless your service agreement says otherwise.

On cancellation, we will make reasonable efforts to help you transition phone numbers and data, subject to carrier rules and technical limitations.

Your Responsibilities

You agree to:

Provide accurate business information for system configuration

Comply with all laws governing your business and your communications with customers, including telephone consumer protection and call recording laws in your jurisdiction

Obtain any consents required from your customers for call recording and text messaging

Not use our systems for unlawful, deceptive, or harassing purposes

Maintain the confidentiality of your account credentials

Third-Party Services

Our systems are built on third-party platforms including customer relationship management software, telephony carriers, and voice processing providers. Their availability, performance, and policies are outside our control. We are not responsible for outages, changes, or failures caused by these providers.

No Guarantee of Results

We do not guarantee any specific increase in calls answered, appointments booked, or revenue. Any figures, examples, or projections we share are illustrative and based on general industry data or the experience of other businesses. Your results depend on your call volume, market, pricing, and operations.

Intellectual Property

All content on arkasoai.com — text, graphics, logos, video, and design — is owned by Arkaso AI and protected by intellectual property law. You may not copy, reproduce, or distribute it without written permission.

System configurations, prompts, and workflows we build for you are licensed for your use during the term of your agreement. Our underlying methods, templates, and know-how remain ours.

Limitation of Liability

To the fullest extent permitted by law, Arkaso is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business, arising from your use of our services.

Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

Indemnification

You agree to indemnify and hold Arkaso harmless from claims arising out of your use of our services, your violation of these Terms, or your violation of any law or third-party right — including claims related to communications sent to your customers through systems we configure.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in North Carolina.

Changes to These Terms

We may update these Terms. The "Last updated" date reflects the current version. Continued use after changes means you accept them.

SMS Messaging Terms

Program: Arkaso AI appointment and customer care messages. When you give us your mobile number and agree to receive texts, for example when you book a call on our website or by phone, Arkaso AI may text you appointment confirmations, reminders, follow-ups about your inquiry, and account notifications.

Message frequency varies. Message and data rates may apply.

Reply STOP to opt out at any time. You will receive one final message confirming you have been unsubscribed. Reply HELP for help, or contact us at [email protected] or (984) 529-8484.

Carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchase.
